Part A: Use of Brick Lane Website
These terms of use (Terms) govern your use of bricklanebrewing.com and BY USING THE WEBSITE YOU ARE AGREEING TO THESE TERMS. You must not use the Website if you do not agree with these Terms.

1. Ownership
The Website and all content is operated and owned by Brick Lane Brewing Co Pty Ltd ACN 614 908 002 with the principal place of business at 41 Imagine Way, Dandenong South 3175.

5. Intellectual Property
All content on the Website is owned, controlled by, or licensed to Brick Lane. Except for viewing the content for your own personal non-commercial use, Brick Lane does not grant you any rights to use the Website or Content for any other purpose unless it expressly consents in writing.

6. Limitation of Liability
Brick Lane does not warrant or guarantee:
• the accuracy or completeness of any information available on the Website;
• that access to the Website will be uninterrupted or error free;
• that any defects will be corrected immediately; or
• that the Website will be free from viruses or other contamination.
Except where prohibited by law, Brick Lane will not be liable to you for any loss, damage, liabilities or claims and expenses that you may suffer due to use of the Website, including use of any information on it. You use the internet and the Website at your own risk.
Nothing in these Terms limits your rights under Australian Consumer Law.

Part B - Customer Agreement
This Agreement is a contract between you and Brick Lane Brewing Co Pty Ltd ACN 614 908 002. It sets out how you can purchase goods online from Brick lane. By completing the customer application process and purchasing goods online from Brick Lane you are bound by this Agreement.

Part C – Other terms that Apply

1. Promotions
From time to time, Brick Lane will offer promotional discounts and other benefits (Promotions) when Products are purchased.
If a Promotion is offered in Store, these will not apply to online purchases (unless specified to be so applicable).

If a Promotion is offered online, these will not apply in store purchases (unless specified to be so applicable).
A maximum of 6 purchases per Promotion is permitted (unless stated otherwise), and all Promotions are subject to stock availability. Brick Lane cannot guarantee that it will honour a Promotion if stock has run out or is not available.

2. Delivery Area
Delivery area: Orders for delivery to addresses that are not in the Brick Lane delivery area cannot be processed. We’ll let you know when you select your delivery option if your address is not in an area where Brick Lane deliver.

3. Date of birth:
Your date of birth may be required by relevant State or Territory liquor licensing laws. You are required to provide this information truthfully at the time of registration or placing your Order.
It is against the law for Brick Lane to sell or supply liquor to, or obtain liquor on behalf of, a person under the age of 18 years. In placing the Order, you warrant to Brick Lane that:
• You are over the age of 18 years and will produce evidence of age to the satisfaction of Brick Lane when requested at the time of delivery,
• Any person that you are obtaining the Goods for, or supply the Goods to, is over the age of 18 years.
4. Business Customers
Customers wishing to set up a business account can email info@bricklanebrewing.com. Business customers must enter into a separate business supply contract with Brick Lane.

5. Changes to or Cancellations of Orders:
If you need to make any changes to or would like to cancel your Order, contact us and we will discuss your options with you. Please contact us on either info@bricklanebrewing.com or 03 9525 0938.

We may cancel your Order before delivery or collection in whole or in part. We may do this even if we have received payment from you or sent you a tax invoice. In the event that your Order is cancelled, we will endeavour to contact you as soon as possible, via one or more of your contact details supplied, to advise of you of the cancellation.

6. Delivery:
Brick Lane will work with our carrier partners to deliver the Goods to you at the delivery address provided. Orders will be processed the following Friday of every week and Deliveries will be made within 7 days thereafter.
We will make our best effort to deliver within the time agreed with you, however events beyond our reasonable control may occur from time to time which means that these delivery times may not be met. Please indicate by checking the relevant BOX if you wish the order to be left if the delivery premises are unattended.
Our carrier partners reserve the right to not complete deliveries and leave collection notification if:

• there is concern of minors present in local vicinity
• Inability for recipient to present adequate proof of age
• Unclear instructions authorising delivery to be left unattended and in a safe place.
Anyone who receives the Goods shall be presumed by Brick Lane to be authorised to receive the Goods. Brick Lane may request evidence that the person collecting the Order is 18 years or older. If the person receiving the Goods is unable or unwilling to provide satisfactory evidence of proof of age, Brick Lane may refuse to deliver the Goods. Brick Lane may refuse to provide liquor to a person who is intoxicated or disorderly.

7. Minimum Order Value
We reserve the right to set a minimum order value. We reserve the right to set a minimum order value.

8. Order Limits
Limits may apply to Orders, as specified on our on-line Site from time to time.

9. Risk and Title
Risk in the Goods passes to you upon delivery at the delivery address.

10. Returns and Refunds
Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major defect or failure of the Goods.
In all other circumstances, we do not accept refunds or requested for exchanges.
Please note that if you wish to return your product due to major defect/failure, the Goods must:
• be returned to Brick Lane 41 Imagine Way, Dandenong South 3175 within 7 days of accepting the delivery;
• be unopened (where possible);
• be in their original packaging.

11. Price and Payments
Delivery Fee: If required by Brick Lane, you must pay the Delivery Fee for each Order with Brick Lane. You acknowledge that the Delivery Fee may not be refundable.

Tax invoice: upon delivery of the Goods, we will provide you with a tax invoice with the total price for the Goods, including credits applied and any other fees.
Method of payment: You shall pay for the Goods at the time of purchase. You may use your credit card Mastercard, Visa, American Express, and Diners.

12. Liability
Brick Lane will use reasonable care and skill in fulfilling the orders.

We are responsible for loss suffered by you as a result of our negligence if it causes personal injury or death.

Subject to negligence as described above, you release and discharge Brick Lane from all forms of direct, special, indirect or consequential loss or damage (including loss of profits, loss of data or loss of damage that may reasonably have been supposed to have been in the contemplation of the parties as at the date of this Agreement) arising out of or in connection with Brick Lane or this Agreement (including the installation, downloading, use or performance of any software related to the Website).

13. Laws
The laws of Victoria govern this Agreement.
